AGREEMENT TO OUR LEGAL TERMS

We are Jack Csaba Ward, doing business as JackiePoot Creations and JackiePoot ("Company," "we," "us," "our"). We operate the mobile application HomeOS (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Jack Csaba Ward, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Minors and Parental Consent

The Services are intended for users who are at least 13 years of age. Users under the age of 18 ("Minors") must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a Minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

1. OUR SERVICES & GEOGRAPHIC RESTRICTION

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.

UK Exclusivity: The App is intended solely for users residing in the United Kingdom. We make no representations that the Services are appropriate or available for use in other locations.

2. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

Except for the Open Source AI Components defined below, we are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as the trademarks and logos ("Marks").

Open Source AI Components

The App utilises the MLX framework and the Qwen2.5-0.5B-Instruct model for local AI processing. These components are provided under their respective open-source licences (e.g., MIT, Apache 2.0). Your use of the App is subject to these licences. Nothing in these Legal Terms limits your rights under, or grants you rights that supersede, the terms of any applicable open-source licence for these specific components.

Your Licence

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and download or print a copy of the Content solely for your personal, non-commercial use.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

  1. All registration information you submit will be true, accurate, current, and complete.
  2. You have the legal capacity and you agree to comply with these Legal Terms.
  3. If you are a Minor, you have received parental or guardian permission to use the Services and are under their direct supervision.
  4. You will not access the Services through automated or non-human means.
  5. Your use of the Services will not violate any applicable law or regulation.

4. PURCHASES AND SUBSCRIPTIONS (APPLE APP STORE)

Billing: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Refunds: All transactions are processed by Apple. We do not process refunds directly. You must contact Apple Support for refund requests. Free Trial: Any unused portion of a 30-day free trial period will be forfeited when you purchase a subscription.

5. ARTIFICIAL INTELLIGENCE (THE "COMPANION")

The App includes an AI feature known as the "Companion."

  1. Local Processing: The Companion operates entirely on-device. No prompt data is sent to our servers.
  2. Accuracy: AI is probabilistic and may "hallucinate" (generate incorrect information). We make no warranties regarding the accuracy of output.
  3. Hardware: Local LLMs are resource-intensive. We are not liable for battery drain or device heating resulting from standard use of the Companion.

6. PROHIBITED ACTIVITIES

You may not use the Services for any purpose other than that for which we make them available. Prohibited activities include:

  • Attempting to reverse engineer, decompile, or disassemble the App's proprietary software.
  • Note on AI: While the underlying Qwen model weights are open-source, you may not attempt to reverse engineer the proprietary integration code or "wrapping" logic developed by us.
  • Using the Services to compete with us or for unauthorized commercial endeavours.

7. USER DATA & CLOUD SYNC

We maintain certain data (such as the Household Feed and Budgets) to provide cloud synchronization.

  • Our Responsibility: We perform regular backups of cloud-stored data. In the event of data loss caused by our gross negligence, we will use reasonable endeavours to restore such data.
  • Your Responsibility: You are responsible for any data you transmit. Except as required by UK Consumer Law, we are not liable for data loss or corruption.

8. TERM AND TERMINATION

These terms remain in effect while you use the Services. We reserve the right to terminate your access for a material breach of these terms. For users with active paid subscriptions, we will provide notice of termination unless the breach poses a security risk or legal liability.

9. LIMITATIONS OF LIABILITY

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law. Subject to the above, our total liability to you for any claim arising from the Services shall be limited to the amount paid by you to us (if any) during the six (6) month period prior to the cause of action, or £50, whichever is greater.

10. GOVERNING LAW

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the non-exclusive jurisdiction of the courts located in London.
